Terms of Service for Marigold Bagels

These Terms of Service ("Terms") govern your use of the website and services provided by RVC Bagels, LLC (doing business as Marigold Bagels). By accessing our website or placing an order, you agree to be bound by these Terms.

1. Product Availability and Pricing

All products are subject to availability. While we strive to keep our online menu current, we reserve the right to limit quantities or discontinue products without notice. Prices are subject to change. California sales tax will be applied to orders where required by law.

2. Ordering and Pickup Policy

  • Pickup Responsibility: You are responsible for picking up your order at 2850 El Cajon Blvd, San Diego, CA during the designated pickup window.

  • Unclaimed Orders: Because our products are perishable, we cannot offer refunds or credits for orders not picked up by the end of the business day.

  • Order Changes: Any changes to standard retail orders must be made at least [Number, e.g., 2] hours prior to the scheduled pickup time.

3. Catering and Special Orders

  • Payment: Full payment or a deposit (as specified at the time of order) is required to secure catering dates.

  • By purchasing our products, you acknowledge these risks. We are not liable for adverse reactions to food consumed from our bakery.

Sesame and Other Allergens: Customers acknowledge that RVC Bagels, LLC (dba Marigold Bagels) produces products containing sesame seeds and sesame flour. Due to the use of shared equipment, including mixers, kettles, and ovens, we cannot guarantee that any product is entirely free of sesame or other allergens (including wheat, milk, and eggs). By purchasing our products, the customer assumes all risks associated with food allergies and sensitivities.

5. Limitation of Liability

To the maximum extent permitted by California law, RVC Bagels, LLC shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our website or the consumption of our products beyond the cost of the order placed.

6. Governing Law

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms shall be resolved in the courts located in San Diego County, California.

7. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the site or our services following any changes constitutes your acceptance of the new Terms.
